1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and CDL Study Buddy ("Company," "we," "us," or "our"). By accessing or using our website at cdlstudybuddy.com or any related services, applications, or content (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Description of Services
CDL Study Buddy provides the following educational services related to commercial driver's license (CDL) preparation:
- CDL Practice Tests: Free online practice tests covering general knowledge, air brakes, combination vehicles, and various endorsements
- ELDT Training Courses: Entry-Level Driver Training courses that comply with FMCSA regulations (49 CFR Part 380)
- Instructional Videos: Educational video content for CDL preparation
- CDL Handbook: Reference materials and study guides
- Training Certificates: Completion certificates for ELDT courses reported to the FMCSA Training Provider Registry
Our ELDT training is provided through our FMCSA-registered training provider status. Upon successful course completion, we report your training to the FMCSA Training Provider Registry (TPR) as required by federal law.
3. Eligibility
To use our Services, you must:
- Be at least 18 years of age (or the minimum age to obtain a CDL in your state)
- Have the legal capacity to enter into a binding agreement
- Provide accurate and truthful information during registration
- Not be prohibited from using the Services under applicable laws
For ELDT training courses, you must additionally:
- Hold a valid Commercial Learner's Permit (CLP) or meet CLP eligibility requirements
- Provide valid identification and CDL/CLP information for FMCSA reporting
- Meet all applicable state and federal requirements for CDL training
4. User Accounts
4.1 Account Registration
To access certain features of our Services, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your login credentials confidential and secure
- Notify us immediately of any unauthorized access to your account
4.2 Account Security
You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from unauthorized use of your account.
4.3 Account Accuracy for ELDT Training
Important: For ELDT training, the information you provide (name, date of birth, CDL number, etc.) will be reported to the FMCSA. Inaccurate information may prevent your training completion from being recorded properly and could delay your ability to take CDL skills tests.
5. ELDT Training Specific Terms
5.1 FMCSA Compliance
Our ELDT courses are designed to comply with FMCSA requirements under 49 CFR Part 380. By enrolling in ELDT training, you understand and agree that:
- Your training completion will be reported to the FMCSA Training Provider Registry (TPR)
- This reporting is mandatory and cannot be opted out of
- The information reported becomes part of federal records
- You must complete all required modules and pass the final assessment with a minimum score of 80%
5.2 Course Completion Requirements
To receive ELDT certification:
- Complete all required theory lessons in full
- Pass the final assessment with a score of 80% or higher
- Provide accurate personal and CDL information for FMCSA reporting
- Certify that all information provided is true and correct
5.3 Training Certificates
Upon successful course completion:
- We will issue a training completion certificate
- Your completion will be reported to the FMCSA TPR within 2 business days
- You may download your certificate from your account dashboard
- Certificate numbers are unique and verifiable
5.4 Theory Training Only
Important Notice: CDL Study Buddy provides theory (classroom) training only. We do not provide behind-the-wheel (BTW) training. You must complete BTW training with a separate, qualified provider before taking your CDL skills test.
6. User Responsibilities
As a user of our Services, you are responsible for:
- Using the Services only for lawful purposes
- Providing accurate and truthful information
- Completing training courses yourself and not allowing others to use your account
- Maintaining the security of your account credentials
- Complying with all applicable laws and regulations
- Respecting the intellectual property rights of CDL Study Buddy and third parties
- Not attempting to circumvent, disable, or interfere with security features
7. Prohibited Uses
You agree NOT to:
- Fraud: Provide false information, impersonate others, or misrepresent your identity
- Cheating: Use unauthorized assistance, share answers, or have others complete coursework on your behalf
- Account Sharing: Share your account or login credentials with others
- Unauthorized Access: Attempt to access areas of the Services you are not authorized to access
- Interference: Interfere with or disrupt the Services or servers
- Scraping: Use automated tools to scrape, collect, or extract content
- Reverse Engineering: Decompile, disassemble, or reverse engineer any aspect of the Services
- Commercial Use: Use the Services for commercial purposes without our written consent
- Copyright Violation: Copy, distribute, or reproduce our content without authorization
- Harmful Content: Upload viruses, malware, or other harmful content
- Harassment: Harass, abuse, or harm other users or our staff
Violation of these prohibitions may result in immediate account termination and potential legal action.
8. Intellectual Property
8.1 Our Content
All content on the Services, including but not limited to text, graphics, logos, images, audio, video, courseware, assessments, and software, is the property of CDL Study Buddy or our licensors and is protected by copyright, trademark, and other intellectual property laws.
8.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial educational purposes. This license does not include:
- The right to copy, modify, or distribute our content
- The right to use our trademarks or branding
- The right to create derivative works
- The right to commercially exploit any content
8.3 User Content
If you submit any content to our Services (such as feedback or suggestions), you grant us a non-exclusive, royalty-free, perpetual license to use, modify, and incorporate that content into our Services.
9. Payment Terms
9.1 Free Services
Our CDL practice tests and certain study materials are provided free of charge.
9.2 Paid Services
Some services, including certain ELDT courses, may require payment. When applicable:
- All prices are displayed in U.S. dollars
- Payment is due at the time of enrollment
- We accept major credit cards and other payment methods as displayed
- All payments are processed securely through PCI-compliant payment processors
9.3 Taxes
You are responsible for any applicable sales tax, use tax, or other taxes related to your purchase.
10. Refund Policy
10.1 Free Courses
Our ELDT courses are currently offered free of charge. No refunds are applicable for free services.
10.2 Paid Courses (If Applicable)
For any paid courses or services:
- Refund requests must be submitted within 7 days of purchase
- No refunds will be issued after significant course progress (more than 25% completion)
- No refunds will be issued after training completion has been reported to the FMCSA
- Refund requests should be submitted to our support team
10.3 Technical Issues
If you experience technical issues that prevent you from accessing paid content, contact our support team for assistance or potential refund consideration.
11. Disclaimers
11.1 "As Is" Basis
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We disclaim all warranties, including but not limited to:
- Implied warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or completeness of content
11.2 No Guarantee of Results
Important: Completion of our courses does not guarantee:
- That you will pass your CDL knowledge or skills tests
- That you will obtain a CDL
- Employment as a commercial driver
- Any specific outcome or result
Success depends on many factors including your own effort, additional training, and meeting all state and federal requirements.
11.3 Educational Purpose
Our content is provided for educational purposes and should not be considered legal, professional, or regulatory advice. Always consult official sources (FMCSA, state DMV) for authoritative information.
11.4 Third-Party Content
We are not responsible for the accuracy, legality, or content of external websites linked from our Services.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- CDL Study Buddy shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability for any claims arising from your use of the Services shall not exceed the amount you paid us in the 12 months preceding the claim (or $100 if you have not made any payments)
- We are not liable for any failure or delay due to circumstances beyond our reasonable control
This limitation applies to all claims, whether based on warranty, contract, tort, or any other legal theory.
13. Indemnification
You agree to indemnify, defend, and hold harmless CDL Study Buddy, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any rights of another party
- Your violation of any applicable laws or regulations
- Any content you submit to the Services
14. Termination
14.1 Termination by You
You may terminate your account at any time by contacting our support team. Upon termination:
- Your access to the Services will be revoked
- You will lose access to any incomplete courses
- Training records already reported to the FMCSA will remain on file
14.2 Termination by Us
We may suspend or terminate your account at any time, with or without notice, for:
- Violation of these Terms
- Fraudulent or illegal activity
- Providing false information
- Cheating or academic dishonesty
- Any other reason at our sole discretion
14.3 Effect of Termination
Upon termination, your right to use the Services immediately ceases. Sections that by their nature should survive termination shall survive, including intellectual property, disclaimers, limitation of liability, and indemnification.
15. Dispute Resolution
15.1 Informal Resolution
Before filing any formal dispute, you agree to contact us and attempt to resolve the dispute informally. Most disputes can be resolved quickly through direct communication.
15.2 Arbitration Agreement
If informal resolution fails, you agree that any dispute arising from these Terms or your use of the Services shall be resolved through binding arbitration, rather than in court, except for claims that may be brought in small claims court.
15.3 Class Action Waiver
You agree to resolve disputes on an individual basis only, and not as part of any class, consolidated, or representative action.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of law provisions.
For any disputes not subject to arbitration, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Salt Lake County, Utah.
17. Changes to Terms
We reserve the right to modify these Terms at any time. When we make changes:
- We will update the "Last Updated" date at the top of this page
- For material changes, we will provide notice through email or a prominent notice on our website
- Your continued use of the Services after changes constitutes acceptance of the modified Terms
We encourage you to review these Terms periodically.
18. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' intent.
18.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and CDL Study Buddy regarding the Services and supersede all prior agreements.
18.2 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
18.3 Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
